NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO TAKE PART IN OR WIN THIS COMPETITION.
1. These terms and conditions (“the Terms and Conditions”) govern the Hour Passion Mendrisio Competition (“the Competition”). This Competition is organised by The Swatch Group Les Boutiques SA ("the Organiser"), with registered office at Länggasse 85, 2504 Biel / Bienne, Switzerland.
2. By participating, you accept both these Terms and Conditions of participation and the privacy policy available at https://www.hourpassion.com/en/privacy-notice . Furthermore, you accept that the Organiser may send you messages in connection with the Competition as per clause 12 hereinafter.
3. Any individual aged eighteen (18) and older, regardless of the place of residence, with a Facebook account is eligible to participate. For participants under the age of eighteen (18), parental or guardian’s permission is required prior to entering the Competition. The Organiser reserves its right to cancel any participation, including an awarded prize, in case no or insufficient proof or permission is received.
4. Employees, including family members, of the Organiser as well as its affiliates, agents and any other party involved in the Competition are excluded from participation.
5. Each participant may only take part in this Competition once and can only win once. Participation via automated mass participation procedures is not permitted.
6. Participation begins on Wednesday, 17.07.2024, 1pm CET, and ends at Thursday, 15.08.2024 at 1pm CET.
7. Participation takes place by following the Facebook page of Hour Passion Outlet Fox Town, liking this post and tag two friends in the comments and by expressly agreeing to these Terms and Conditions of participation. Participants are responsible for the accuracy of the information they provide.
8. Despite compliance with the instructions in accordance with clause 7, participation may be made impossible for technical or other reasons beyond the Organiser's control. The participant hereby releases the Organiser from any liability whatsoever.
9. The Organiser reserves the right to exclude any participant who provides incorrect or misleading information from the Competition at any time.
10. The winner will receive as a prize a Tissot PRX Digital, T137.463.11.050.00, with a value of CHF 325.00.
11. The winner will be selected at random from all participants on Friday, 16.08.2024.
12. The winner will be notified by private Facebook message on Saturday, 17.08.2024, and must confirm acceptance of the prize by private message within 48 hours, i.e. until Monday, 19.08.2024, 12pm CET. If a winner cannot be contacted, their claim to the prize will be forfeited and a replacement winner will be drawn, for which the same rules of reply apply.
13. The winner is obliged to provide its identity, including first and family name, age, address, e-mail and phone number. At the request of the Organiser the winner may have to submit the necessary documents to prove their identity. In case of a dispute about the identity of the person, the participation will be allocated to the person that will be identified as owner of the Facebook account.
14. The prize will be sent to the winner by post to the address provided as per clause 13. The risk passes to the winner at the moment when the prize is handed over to the post.
15. Cash payment of the prize is not possible; the prize is non-transferable. The Organiser reserves the right to replace the prize with a prize of equal value.
16. Any taxes or duties levied on the prize, including taxes, duties, fees and charges upon postal delivery of the price, shall be borne by the winner.
17. The participant declares its agreement that, if elected winner, the Organiser may use the name and photo of the participant as visible on its Facebook account on the website, online channels or print publications of the Organiser, subject to the participant’s legal right to reject such use.
18. The Organiser reserves the right to exclude participants who violate the conditions of participation from the Competition. The Organiser reserves the right to adjust the conditions of participation and to modify or terminate the Competition, if it is infected by computer viruses or impaired for other technical reasons. The Organiser further reserves the right to select an alternative winner if the Organiser reasonably believes that a winner has breached the Terms and Conditions.
19. The Competition is not affiliated with Meta (incl. Facebook) and is in no way sponsored, endorsed or organised by Meta (incl. Facebook). Any participant releases Meta (incl. Facebook) from any responsibility whatsoever in connection with this Competition.
20. The Competition is void where legally not permitted.
21. The Competition is subject to Swiss law, without regard to any conflict of law provisions. The exclusive place of jurisdiction is Biel/Bienne. Legal recourse is excluded.
